The negligent driver had no insurance. We sought uninsured motorist coverage from the employer’s car insurance. The insurance company initially refused, arguing the client was not 'occupying' the truck. We convinced the Trial Court and Court of Appeals that the client was entitled to coverage, and the Ohio Supreme Court refused the insurance company’s appeal. Case is State v. Smith, 2012-Ohio-781.
