Case Details

Plaintiff, a machinist, sustained acute hearing loss, pain in both ears, severe headaches, and permanent tinnitus and hypercausis after a locomotive horn was inadvertently sounded in a repair shop. The horn blast was due to a co-worker placing a spotter cable on top of the locomotive console, activating the horn.

Additional Notes

Plaintiff established that a history of such horn blasts existed. Defense contested liability mildly but vigorously contested damages, arguing plaintiff failed to mitigate by pursuing other work opportunities. Case: Paul D. Weaver v. Norfolk Southern Railway Co., Roanoke City Circuit Court, Virginia, No. CL07-612. Attorneys: Willard J. Moody, Jr. and Michael R. Davis.
