Contract Dispute

Attorney John Orton obtained a successful settlement in the case of Hoem v. Town of Franklin, et. al. Wilma Hoem sued the Town of Franklin alleging that the Town breached its contract with her regarding the re-construction of a town road across her property. The Town had agreed to provide Hoem with all the dirt removed from the construction site, but during construction, numerous truck loads of dirt were delivered elsewhere. Initially, this case was dismissed on summary judgment, but Attorney Orton successfully appealed the case. The Court of Appeals agreed with Attorney Orton, reversed the trial court, and remanded the case for further proceedings. On the opening day of trial, the parties stipulated to the entry of Judgment in favor of Mrs. Hoem and against the Town in the amount of $35,000.

Our client was walking across Wal-Mart’s parking lot when she accidentally stepped into a pothole, causing her to fall and injure her knee.
