A Tyler woman recently recovered a six figure settlement of her claims related to her car wreck. The plaintiff hired Tab Lawhorn in 2019 to represent her against the negligent driver who hit her head on. After an initial settlement offer of $50,000.00 was tendered by the carrier, a claim was filed under the plaintiff's own underinsured motorist policy. The main point of contention was plaintiff's complaint of shoulder pain, which was ultimately reviewed through MRI. Lawhorn argued that his client's pain was a result of a tear in her rotator cuff. The plaintiff ultimately was sent for further diagnostics where she received a 3T MRI which showed much more detail. The results of the 3T MRI revealed a clear tear in the Plaintiff's rotator cuff. Further, a surgeon recommended surgery to repair the tear and related the cause of the tear to be the collision that Plaintiff was involved in. Suit was filed in Smith County, Texas and a settlement was reached sixty days before trial.
