In this case, the injured person, who we will call “Jane,” was from West Virginia and had traveled to Harrisonburg to attend appointments. She was stopped at a stop light in Harrisonburg when her car was rear-ended by the driver of another vehicle, who we will call “Bob.” After the rear-end collision, “Jane” got out of her vehicle and stood on the sidewalk waiting for police. As she was standing on the sidewalk, a large, city-owned truck approached and struck the rear of “Bob’s” vehicle, causing it to hit the curb, jump the sidewalk, and hit Jane who was standing nearby. Traffic was moderately heavy on the interstate and there were pockets of slowing traffic. As the plaintiff entered one of those slow moving areas, he brought his vehicle to a stop. A tractor trailer driver was not paying attention to the roadway and barreled his truck into the rear of the plaintiff’s car. The impact of the collision forced the Maryland vehicle into a spin.
