DUI, Driving on a Suspended license
Upon investigation, my 51 year-old client (with approximately two prior DUI convictions) was observed behind the wheel of a parked car on the side of a road. He informed the officer that the car was actually driven by a relative, until it began to malfunction and was no longer able to drive. Client was aware of his license suspension. When asked, client refused to submit to field sobriety test, and was cited with DUI and Driving on a Suspended license. Following negotiations, the DUI was amended down to a Reckless driving ( probation terminated upon payment of $1,000 fine; no community service and no risk reduction class); the remaining suspended license charge was dismissed.
