Breach of Contract

Williams & Connolly client Genentech prevailed in a major trial against Biogen in a long-running, nine-figure breach of contract case concerning unpaid royalties. After the jury deadlocked 7-1 in Genentech’s favor, both sides agreed to let the district court resolve the case on the trial record. The Court entered a lengthy order deciding the case in Genentech’s favor, awarding all of the damages Genentech requested-over $88 million in unpaid royalties, an amount that will increase to over $122 million when pre-judgment interest is included.

Contractual Indemnification

Williams & Connolly client Vimian Group AB won a $40M+ bench trial victory in the Superior Court of Delaware in a contractual indemnification case that arose out of an M&A transaction. Judge Meghan A. Adams found in favor of clients, awarding them $40.2 million in damages from the two defendants who went to trial. Judge Adams also rejected all the defendants’ counterclaims, for which they sought $13.5 million. In total, including prior settlements with three co-defendants, Williams & Connolly obtained an entitlement to compensation for its clients exceeding $70 million.
