Case Details
Represented a young man employed as a manager at an all-night diner. On a cold and snowy December evening, he ran into a semi-truck carrying supplies for a large on-line retailer that was attempting to back up onto a limited access country road. The semi had been stationary across the roadway for 4-5 minutes. Client sustained an injury to his right upper arm and a partially amputated right pinky finger.
Additional Notes
Police cited client for failing to allow an assured clear distance. We successfully argued that under federal trucking regulations, the semi-trailer did not properly follow the rules of the roadway and was not readily ascertainable due to road conditions and decreased visibility from precipitation.
