Case Details
Represented a young man employed by a tree trimming company. While picking up trimmed branches, he was struck by a negligent, uninsured driver who failed to stop after cresting a hill. Client sustained significant injuries.
Additional Notes
The negligent driver had no insurance. We sought uninsured motorist coverage from the employer’s car insurance. The insurance company initially refused, arguing the client was not 'occupying' the truck. We convinced the Trial Court and Court of Appeals that the client was entitled to coverage, and the Ohio Supreme Court refused the insurance company’s appeal. Case is State v. Smith, 2012-Ohio-781.
