Motor Vehicle Collision
Carolyn Demougeot recently secured a significant arbitration victory for her clients injured in a motor vehicle collision in Montgomery County. The matter proceeded to binding arbitration on the issue of damages after the Defendant conceded liability. Following an evidentiary hearing, the arbitrator awarded a six-figure recovery to Ms. Demougeot’s clients, including both economic and non-economic damages.
Medical Malpractice, Wrongful Death
Ben Laufer obtained a defense verdict for a skilled nursing facility in the Circuit Court for Allegany County, Maryland. The Plaintiffs brought a wrongful death claim and survival action against the Defendants, a skilled nursing facility, the attending physician, and the primary care physician, based on diabetic care rendered during the decedent’s admission to the skilled nursing facility and following her discharge. After a 9-day jury trial, the jury returned a verdict in favor of the Defendants in less than one hour. The jury found that the Defendants complied with applicable standards of care. Judgment was entered in favor of all of the Defendants.
Medical Malpractice
ADCVR partners Erica C. Mudd and Gretchen A. Slater secured the dismissal of all claims asserted against their client in a medical negligence action that had been pending in the Circuit Court for Prince George’s County, Maryland, for close to three years. The Court agreed that Plaintiffs failed to file any Supplemental Certificates of Qualified Expert, as required by Maryland’s Health Care Malpractice Claims Act, and dismissed the case.
Slip and Fall, Premises Liability
Jeremy R. Krum and Robert D. Anderson obtained judgment in favor of their client in a significant slip and fall claim tried in the Circuit Court for Anne Arundel County, Maryland. After a hard fought 6 day jury trial, the jury determined that the Defendant health care provider had acted reasonably throughout his care of the Decedent.

The medical malpractice action involved allegations of medical negligence relating to arthroscopic surgery and compartment syndrome. After a four-day jury trial, the jury returned a verdict in favor of the defendant in less than one hour. The jury found that the health care provider complied with applicable standards of care. Judgment was entered in favor of the defendant.
