A Madison Wisconsin jury levied a $44 million dollar award, finding the railroad's actions to be bad, singling out the conductor, thwarting his attempts to continue as a conductor, and flagrantly misrepresenting hearing requirements.

Ryan Torbenson, a Canadian Pacific Railway (CP) conductor, was injured in 2018 when he was ordered by a supervisor to remove a defective end of train device (EOT). The EOT unexpectedly released, causing him to lose his footing and smash his left hand between the EOT and the coupler. The jury found CP 100% negligent and rejected CP's arguments that Torbenson was exaggerating his injury.

Christopher Walls, a Union Pacific Railroad Conductor, was injured when a switch was misaligned, causing the train to stop and eject him from the lead car. He suffered significant injuries to his right leg, including a tibial plateau fracture, dislocated knee, and required five surgeries, including a full knee replacement. His injuries prevent him from returning to work as a conductor.
