Kurt's practice has been exclusively devoted to complex fiduciary breach litigation, including class actions brought under the Employee Retirement Income Security Act (“ERISA”). He has been actively involved in all aspects of complex litigation, from pre-complaint investigation through judgment. He was a member of the trial team in Tussey v. ABB, Inc., the first full trial of any 401(k) excessive fee case brought under ERISA that resulted in a $36.9 million judgment.
