Case Details
A Santa Fe jury awarded a Valencia County family $36 million in damages following a lawsuit against State Farm Insurance. The lawsuit was prompted by a fatal head-on collision in 2017 that killed Andrea Lovato and seriously injured her 4-year-old nephew. State Farm argued her policy limit remained at $25,000 despite an upgrade to $1 million and claimed Lovato was at fault. The jury found State Farm's contract provided $1 million in coverage and that both drivers shared equal responsibility.
Additional Notes
Verdict included $12 million in damages and $24 million in bad faith and breach-of-contract damages, with $20 million as punitive damages. This was one of the largest 'bad faith' awards against an insurance company by a New Mexico jury.
