The victim was survived by his adult children. Our client’s father suffered 2nd and 3rd degree burns on 15% of his body from scalding water in the bathtub at his apartment as a result of the landlord’s negligent installation and maintenance of the water heater at the premises. Unfortunately, he succumbed due to complications from the burns. The defendant’s insurance company rejected plaintiff’s claims for years, offering only $30,000 on the eve of trial. Defendant’s claimed that temperature of the water was reasonable, that the victim’s actions caused his burns, and that he died from unrelated conditions which preexisted the accident. All of those claims were successfully refuted at trial which led the defendant’s insurance company to offer near policy limits to settle this case before verdict.
