T.B. was walking along Apalachee Parkway in Tallahassee when he was struck by a car operated by a Boston Scientific employee. The impact threw T.B. onto the hood of the vehicle and then tossed him into a culvert on the side of the road. T.B is paralyzed from the neck down as a result of the accident. Boston Scientific denied any liability for the accident, claiming T.B. was in the roadway or attempting to cross the roadway at the time of the accident. Following a week long jury trial, Anderson & Hart was able to secure a $6 million recovery for T.B.

V.F. was employed by Paver Module, a concrete paver manufacturer. V.F. suffered an injury to his foot and ankle which necessitated a surgery. While recovering from the surgery, V.F. was placed on a morphine pump which malfunctioned and left him a brain damaged quadriplegic. Anderson & Hart were able to obtain permanent total disability benefits, a handicapped accessible housing, 24 hour nursing care and a handicapped accessible van for V.F. The claim was ultimately settled for $3.675 million. In addition to the monies paid, V.F. received title to the handicapped accessible home and van obtained earlier for him.

Wrongful Death

M.A. was murdered by a co-employee who he worked with at Adkins Transfer. His death left behind his young wife and their two small children. After M.A.’s Estate was denied workers’ compensation death benefits, Anderson & Hart filed a wrongful death claim against the employer. After years of litigation, including an appeal dismissing a defendant in the case, Anderson & Hart was able to establish that Adkins Transfer was negligent in hiring the co-employee. Anderson & Hart ultimately obtained a judgment for M.A.’s family in the amount of $2.3 million.

J.B. was operating a MAC dump truck down a bridge in west Bay County when a compact car driving in the opposite direction was struck from behind by a semi-truck. The impact propelled the compact car into the path of J.B.’s dump truck. The driver and passenger in the compact car were killed and the dump truck flipped multiple times with J.B. behind the wheel. J.B. suffered serious injuries, including unwarranted guilt associated with the two deaths. Anderson & Hart obtained permanent total disability and medical benefits for J.B. and filed suit against the owner of the semi-truck. After intense litigation, Anderson & Hart were able to obtain settlement benefits in excess of $1 million for J.B.
